Exclusion of the right of family reunion for foreigner with subsidiary protection status

The amendment of the Residence Act will exclude the right for family reunion for a period of two years in cases in which foreigners will obtain the subsidiary protection status after the new provision entered into force. Therefore, the forthcoming amendment will not affect the right for family reunion in cases where foreigners already reached the subsidiary protection status.

The intended provision explicitly states that the restriction of family reunification is only applicable to foreigners who will obtain subsidiary protection status after the new provision entered into force. Those who are already recognized as persons with subsidiary protection status are entitled to get visa for family reunion without any new restrictions.

Foreigners who obtained refugee status or will get this status in future are not affected by the amendment of the Residence Act. They have the right for family reunification independently of the new provision.
