A Turkish child, who was born in Germany, has the right to stay in Germany until the age of 16

On December 18, 2013 the administrative court in Darmstadt ruled that a Turkish child, who was born in Germany, has the right to stay in Germany without a resident permit until the reaching of the age of 16 (case 5 K 310/12.DA).

The right requires that the child has a passport and one of the parents is an employee, who is residing legally in Germany. If these conditions are met, the child is under the scope of the standstill clause of Article 13 of the Decision 1/80 and is entitled to claim the benefit of § 2, paragraph 2 DVAuslG1990.
